CONDIZIONI GENERALI DI VENDITA

1. Generalità
1.1 Dichiarazione ai sensi della direttiva 95/16 CE: i componenti di sicurezza (Allegato IV) sono accompagnati dalla dichiarazione CE di conformità.
Tutti gli altri componenti sono idonei, entro i limiti delle loro caratteristiche tecniche, ad essere installati sugli ascensori.
1.2 Il contratto di vendita viene perfezionato con la nostra accettazione dell'ordine.
1.3 Salvo diversi accordi accennati e confermati per iscritto ogni ordine del Cliente è subordinato senza riserve alle presenti condizioni di vendita.
2. Assicurazione della qualità
2.1 Donati applica un sistema di assicurazione della qualità secondo UNI EN ISO 9002.
3. Offerte
3.1 Le offerte, salvo diverse indicazioni scritte, hanno validità di 30 giorni dalla data di emissione.
4. Prezzi
4.1 I prezzi di vendita e le variazioni degli stessi sono esposte nell'area clienti sul sito web www.donati.it
5. Ordini
5.1 Accettiamo solo ordini scritti. Eventuali deroghe a quanto sopra non possono costituire in nessun caso un precedente e sono a totale rischio del Cliente.
5.2 E' nostra facoltà accettare o meno modifiche o annullamenti d'ordine in ragione dello stato di avanzamento della commessa stessa.
6. Confezioni
6.1 La quantità dei prodotti ordinati può essere da noi modificata per renderla omogenea alla quantità per
confezione riportata in catalogo o listino.
7. Forniture
7.1 Le informazioni, caratteristiche tecniche, dimensioni hanno carattere indicativo.
7.2 E' nostra facoltà apportare modifiche ai prodotti atte a migliorarne la qualità.
8. Minimo ordinabile
8.1 Per ordini mensili inferiori a € 100 saranno addebitate € 10 per spese amministrative.
9. Termini di consegna
9.1 I termini di consegna sono solo indicativi. Nessuna garanzia è data sui termini di consegna, salvo
sia espressamente indicata per iscritto.
10. Imballo
10.1 Le merci sono rese adeguatamente imballate.
10.2 Le spese di imballo si intendono a carico del Cliente.
10.3 Le bobine rese entro 18 mesi in buono stato in porto franco saranno accreditate con svalutazione del 10%
11. Trasporto
11.1 La merce è resa normalmente Franco nostro magazzino. Nel caso di resa Franco magazzino del Cliente,verranno addebitate in fattura le relative spese di trasporto.
11.2 Il rischio di perdita, danneggiamento e furto passa al Cliente al momento della messa in consegna a un trasportatore o spedizioniere.
12. Garanzia
12.1 Garantiamo che i prodotti forniti siano liberi da difetti di materiale o di fabbricazione.
12.2 I reclami devono esserci denunciati per iscritto entro il periodo di validità della garanzia e da noi riscontrati.
12.3 La garanzia decade in caso di manomissione, deterioramento a noi non imputabile e per impieghi in contrasto con quanto prescritto dalle norme o quanto riportato in catalogo.
12.4 Salvo che i prodotti siano da noi installati la garanzia copre esclusivamente il prodotto.
12.5 La durata della garanzia è di 12 mesi dalla data di consegna.
13. Resi
13.1 La restituzione delle merci deve essere con noi concordata e autorizzata.
13.2 Salvo diversi accordi scritti le spese di restituzione sono sempre a carico del Cliente.
13.3 Se la causa della restituzione delle merci è imputabile al cliente l'accredito sarà dell'80% del prezzo di fattura.
14. Pagamenti
14.1 I termini di pagamento sono accordati e definiti nelle condizioni particolari al cliente.
15. Competenze
15.1 Per quanto non previsto nelle presenti Condizioni Generali di Vendita fanno riferimento le norme del
Codice Civile.Per ogni controversia sarà esclusivamente competente il Foro di Milano.

GENERAL TERMS AND CONDITIONS OF SALE

1. General
1.1 Declaration regarding the 95/16/EC regulation: The safety components (annex IV) include the EC declaration of conformity.
All the components are suitable for lift installation, within their technical characteristic limits.
1.2 The sales contract is executed with the acceptance of the orders on behalf of Donati S.r.l. (hereinafter Donati).
1.3 All customer orders are non negotiable and subject to the following terms of sale , with the exception of modified and confirmed agreements in writing.
2. Quality Assurance
2.1 Donati provides a quality assurance based on UNI EN ISO 9002.
3. Offers
3.1 The offers are valid for 30 (thirty) days from the date of issue except where otherwise agreed in writing.
4. Prices
4.1 The prices and their variation are displayed in the members area in our website www.donati.it .
5. Orders
5.1 Only written orders are accepted. Any eventual variance does not constitute a precedence and is at the client's sole liability.
5.2 It is our right to accept or refuse any modifications or cancellations depending on the stage of the order.
6. Packages
6.1 The quantity of the products ordered may be modified by us in order to match the description as shown in the Catalogue or Price List.
7. Supplying
7.1 Information, technical characteristics and dimensions are approximate.
7.2 It is our right to modify the product in order to increase the quality.
8. Minimal orders
8.1 Monthly orders less than € 100 will be charged an administrative fee of € 10.
9. Delivery dates
9.1 The delivery dates are only general. No warranty is given on delivery dates, unless otherwise specified in writing.
10. Packaging
10.1 Goods are properly packaged by us.
10.2 Packaging costs are charged to the client.
10.3 Reels in good condition, which are returned within 18 months at the client's expense, will be reimbursed incurring a 10% depreciation value.
11. Transportation
11.1 Goods are ex warehouse. Transportation costs are charged on the invoice for client warehouse delivery.
11.2 The risk of loss, damage and theft is passed to the client once the goods are in the possession of the transporter or forwarder.
12. Warranty
12.1 We guarantee that the products are free from material or workmanship defects.
12.2 Claims must be made in writing and verified by us within the warranty period.
12.3 The warranty is void in the case of goods being tampered with and/or damaged or used for purposes as othrwise defined by standards or in our Catalogue.
12.4 The product is only covered by the warranty, except when installation of the products is carried out by Donati.
12.5 The warranty period is 12 months from the date of delivery.
13. Return of Merchandise
13.1 The return of any merchandise must be agreed and authorised by Donati.
13.2 The cost of returned merchandise is always at the client's charge, unless otherwise specified in writing.
13.3 Refunds of non defective merchandise will be credited at 80% of the invoice value.
14. Payments
14.1 The terms of payment are given and defined in the Price List.
15. Disputes
15.1Please refer to the Italian Civil Code fo general terms and conditions of sale not mentioned herein. Any disputes will be settled by the Court of Milan.
